Terms of Use — Polarly

Please read these Terms carefully. By installing the app, creating an account, or using the website polarly.app, you confirm that you have read and agree to be bound by these Terms. If you do not agree, please do not use the Service.

1General

Polarly is a mobile app (iOS and Android) and the website polarly.app that collect and display information about Earn and Launchpool products of cryptocurrency exchanges (the “Service”). The Service is operated by Ihor Porada (the “Operator”, “we”, “us”). You, the user of the Service, are referred to as “you”.

These Terms govern access to and use of the Service. By using the Service, you enter into an agreement with the Operator on these Terms. Together with the Privacy Policy, they constitute the entire agreement between you and the Operator regarding the Service.

2Definitions

Service — the Polarly app, the website polarly.app, and related features.
Content — data, text, rankings, yield rates, charts, and other information within the Service.
Exchange — a third-party cryptocurrency platform (including Binance, Bybit, OKX, Bitget, MEXC, Gate, BingX, KuCoin, WhiteBIT) whose data the Service aggregates.
Earn / Launchpool — categories of exchange products whose information the Service displays.
Affiliate link — a link to an Exchange for which the Operator may receive compensation for referrals or sign-ups.
Watchlist — the list of coins you have chosen to track in the Service.
Portfolio — a feature for keeping track of your crypto assets based on Transactions you enter yourself.
Transaction — a record of a purchase, sale, or transfer of an asset that you manually add to the Portfolio.

3What Polarly is and is not

The Service is informational and for reference only. It collects publicly available data from Exchanges and third-party sources (including market data providers), organises it, and helps you compare Earn and Launchpool products, keep track of your Portfolio based on data you enter yourself, and receive notifications based on your Watchlist and event reminders.

Polarly is NOT: an exchange, broker, dealer, investment adviser, or cryptocurrency wallet. The Service does not hold your funds, does not execute transactions, does not manage assets, and has no access to your accounts on Exchanges. You carry out all operations with assets directly on the Exchanges, subject to their terms. The Portfolio is your own record-keeping: the Service does not reconcile the Transactions you enter with the Exchanges and does not verify that they match your actual operations.

4No financial advice

No part of the Content — including yield rates (APY), rankings, product lists, Portfolio valuations, effective yield calculations, or any other calculations — constitutes investment, financial, legal, or tax advice or a recommendation to buy, sell, or hold any assets.

You make all decisions yourself and at your own risk. Before acting, do your own research and, where appropriate, consult qualified professionals.

Crypto-asset risk Cryptocurrencies and related products are high-risk and volatile. Yields are not guaranteed, product terms may change, and you may lose your entire investment.

5Accuracy and availability of data

Rates, terms, and product parameters are set by the Exchanges and change frequently, sometimes several times a day. The Content may be incomplete, outdated, or contain errors and is provided on an “as is” basis.

Information in the Service is a reference point. Always verify the actual terms of a product, its availability in your jurisdiction, and its final parameters directly on the relevant Exchange before taking any action. Portfolio valuations are calculated from third-party market data: they may contain gaps, differ from the actual execution prices of your trades, and are indicative only. The Operator does not guarantee uninterrupted, error-free, or continuous operation of the Service.

6Exchanges, third-party services, and affiliate links

The Service contains links to Exchanges and other third-party resources. The Operator does not control them and is not responsible for their content, products, availability, or actions. When you follow a link, you become subject to the terms and privacy policies of the relevant party, which we recommend you review separately.

Some links are affiliate links: the Operator may receive compensation from an Exchange for referrals or sign-ups. This involves no additional cost to you and does not affect the data displayed — rates and product parameters are taken from public sources regardless of any partnership.

7Account

Some features require an account. Sign-in is performed via third-party authentication providers — Google Sign-In and Sign in with Apple. You are responsible for safeguarding access to those accounts and for actions taken in the Service under your account.

By using the Service, you confirm that you are at least 18 years old and have the capacity to enter into this agreement. The Service is not intended for persons prohibited from using cryptocurrency products under the laws of their jurisdiction.

8Push notifications

The Service may send push notifications related to the coins in your Watchlist (for example, about new products), as well as reminders about events you have subscribed to (for example, a launchpool start or a token unlock). You can disable notifications at any time in the app or device settings.

9Acceptable use

When using the Service, you agree not to:

perform automated data collection (scraping) or send bulk or excessive requests that burden the Service;
reverse engineer, decompile, or reproduce the source code, or circumvent technical or security measures;
use the Service in violation of the law or the rights of third parties;
copy, resell, or commercially redistribute the Content as your own without the Operator’s written permission;
interfere with the Service or attempt to gain unauthorised access to its systems.

10Intellectual property

The app, the website, their design, interface, source code, and the Polarly name and logo belong to the Operator and are protected by law. The names, trademarks, and logos of Exchanges and cryptocurrencies are the property of their respective owners and are used solely for identification.

11Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without any express or implied warranties, including as to accuracy, completeness, fitness for a particular purpose, or uninterrupted operation, to the maximum extent permitted by law.

12Limitation of liability

To the maximum extent permitted by law, the Operator is not liable for any direct or indirect damages arising from: use of or inability to use the Service; decisions made on the basis of the Content; the acts or omissions of Exchanges; price fluctuations; or the loss of funds or assets. You use the Service at your own risk.

13Indemnification

You agree to indemnify the Operator for reasonable losses and expenses arising from your breach of these Terms or of applicable law while using the Service.

14Changes to these Terms

The Operator may amend these Terms from time to time. The current version is indicated by the date at the top of the page. By continuing to use the Service after changes take effect, you accept the updated Terms. We recommend reviewing this page periodically.

15Suspension and termination of access

The Operator may restrict, suspend, or terminate your access to the Service (in whole or in part) in the event of a breach of these Terms, legal requirements, or for technical reasons, without prior notice where reasonable.

16Governing law and dispute resolution

These Terms are governed by the substantive law of Ukraine. The parties will use reasonable efforts to resolve disputes through negotiation. If no agreement is reached, the dispute will be resolved by the courts of Ukraine in accordance with applicable law. If you are a consumer, you retain the protections of mandatory consumer-protection law, including the right to bring proceedings before a court at your place of residence.
